1. Agreement
These Terms of Use ("Terms") are an agreement between you and the developer of Aguinal-DUE ("we", "us", "our"). They cover the Aguinal-DUE mobile app (the "App") and this website. Our Privacy Policy explains how the App handles information and is part of these Terms.
If you don't agree to these Terms, please don't use the App.
2. Who can use the App
The App is designed for adults who give gifts to their godchildren and other young relatives. You must be at least 18 years old, or the age of majority where you live, to use it.
3. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own non-commercial use, subject to these Terms and the rules of the store you downloaded it from.
You may not copy, modify, distribute, sell or lease any part of the App, or reverse engineer or attempt to extract its source code, except where the law expressly allows it.
4. Your content
Everything you enter into the App, such as names, notes, amounts and photos, is "Your Content". You own Your Content. Because it stays on your device, we don't receive it and don't claim any rights to it.
You are responsible for Your Content and for anything you choose to share from the App, including share cards, badges, Wrapped slides and backup files. Make sure you have the right to enter and share it, and that doing so respects other people's privacy and the law, including the Philippine Data Privacy Act of 2012.
5. Children's information
The App lets you record information about children. Please handle it with care.
- Only add information you'd be comfortable with the child's parent or guardian knowing you keep.
- Get the parent's or guardian's permission before sharing a child's photo or full name publicly.
- Use the App's privacy tools, such as face-cover stickers, cartoon avatars and hidden names, when you share.
- Never use the App to embarrass, shame or pressure a child or their family.
6. Local data and backups
The App stores your data only on your device. We don't keep a copy, so we can't restore lost data. Uninstalling the App, resetting your phone, losing your device, or using Reset all data can permanently erase it.
You are responsible for keeping backups using Settings › Share backup file. Backups don't include photos, and restoring a backup replaces the data currently in the App.
7. Premium packs
The App is free to download and use. Some optional content is available as one-time in-app purchases ("Premium Packs"), such as extra share-card templates and an unlimited roster. The free version allows up to 15 inaanak on the roster.
- Payment. Purchases are processed by Google Play or the Apple App Store under their terms. Prices are shown in the store before you buy and may vary by country, include applicable taxes, and change over time.
- One-time, not a subscription. Premium Packs are non-consumable. You pay once and keep access for as long as the App is available to you, on devices signed in to the same store account.
- Restoring. Purchases are tied to your store account, not to a backup file. On Android, they are restored automatically. On iOS, use Restore in the App.
- Refunds. Refund requests are handled by the store under its own policies. We can't issue refunds directly because we don't process payments.
- Changes. We may improve or adjust the content of a Premium Pack over time. We won't remove the core feature you paid for while we continue to offer the App, unless required by law or a store's rules.
- Tips. "Pamasko para sa developer" tips are voluntary gifts to the developer. They don't unlock features, buy support or create any obligation. Tips on Android are paid through PayPal and on iOS through the App Store, and refunds follow PayPal's or Apple's policies.
8. Fun features
Some features exist purely for laughs, including Spin ng Pamasko, Hiding Mode, the "Your heart says" budget meter, Final Notice cards and Pamasko Wrapped.
Spin ng Pamasko is a random suggestion tool. You don't pay to spin, nothing of value is wagered or won inside the App, and any gift you decide to give is entirely your choice. Hiding Mode only changes what the App shows. It doesn't change your records or hide anything from anyone in real life.
9. Not financial advice
Budgets, totals, envelope checklists and the Bagong Pera bill breakdown are planning aids based on what you enter. They aren't financial advice, and we don't guarantee that any bank or ATM will have specific bills available. Please check amounts before withdrawing or giving money.
10. Acceptable use
You agree not to use the App or anything it creates to:
- harass, bully, shame or threaten anyone, including the people on your roster;
- share someone else's personal information or images without permission;
- break any law, or infringe anyone's intellectual property or privacy rights;
- interfere with the App, bypass purchase checks, or distribute modified versions of it.
11. Intellectual property
The App and this website, including the Aguinal-DUE name, logo, wallet mascot, illustrations, stamps, card templates, sounds and text, belong to us or our licensors and are protected by law. These Terms don't give you any right to use our branding.
You may share images you create with the App's share features for personal, non-commercial purposes. Fonts used in the App are licensed under the SIL Open Font License.
12. App stores
If you downloaded the App from Google Play or the Apple App Store, you also agree to that store's terms. These Terms are between you and us, not with Google or Apple. They have no obligation to provide maintenance or support for the App and aren't responsible for it or for any claims about it.
If you downloaded the App from the Apple App Store: to the extent the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation regarding the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Disclaimers
We work hard to make the App reliable and fun, but it's provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise that the App will be error-free, uninterrupted, or that reminders will always arrive, since notifications depend on your device settings.
14. Limitation of liability
To the fullest extent allowed by law, we won't be liable for any indirect, incidental, special or consequential damages, or for lost data, lost money or hurt feelings, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for Premium Packs in the 12 months before the claim, or ₱500 if that's greater.
Some places don't allow these limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
15. Termination
You can stop using the App at any time by deleting it. We may suspend or end your license if you seriously or repeatedly break these Terms. Sections that by their nature should survive, such as ownership, disclaimers and limitation of liability, continue to apply after termination.
16. Governing law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute will be handled by the proper courts of the Philippines, unless the consumer laws of the country where you live give you the right to bring a claim there.
17. Changes to these Terms
We may update these Terms from time to time. We'll post the new version on this page and update the "Last updated" date. If a change is significant, we'll let you know in the App. Continuing to use the App after a change means you accept the updated Terms.
